✦ THE AGREEMENT
Terms of Service
These Terms of Service govern your access to and use of the YaySite website-building platform and related services.
Last updated: September 8, 2026
1. Agreement and eligibility
By creating an account, accessing, or using YaySite, you agree to these Terms of Service and the Privacy Policy. If you do not agree, do not use the service.
You must be legally able to enter into this agreement. If you use YaySite for a company, agency, or client, you represent that you have authority to bind that organization and that you will ensure its users follow these terms.
2. The YaySite service
YaySite provides tools to import business information, generate an initial website, edit content, add features such as AI Chatbot and Lead Capture, connect domains, preview sites, and publish websites. Features, limits, plans, and availability may change as the service develops.
YaySite is a production tool, not a replacement for your review. You must check imported details, generated copy, reviews, photos, calls to action, contact information, legal notices, and claims before publishing.
3. Accounts and security
You are responsible for providing accurate account information, keeping access credentials secure, and all activity under your account. Do not share access in a way that bypasses plan limits or security controls.
Notify us promptly at support@yaysite.com if you believe your account has been compromised. We may suspend or restrict access to protect the service, users, or third parties.
4. Your content and permissions
You retain ownership of content you submit or upload, including business information, photos, logos, copy, reviews, and domain details. You grant YaySite a limited, worldwide, non-exclusive license to host, reproduce, modify as technically necessary, display, and transmit that content only to operate, improve, secure, and provide the service.
You represent that you have all rights, permissions, and consents needed for YaySite to process and publish your content. You are responsible for its accuracy, legality, and compliance with advertising, privacy, accessibility, intellectual-property, and industry-specific requirements.
5. Google and other third-party data
You may provide a Google Business Profile or Google Maps link to help create a website. You must use the correct business listing and have permission to create or manage a website for that business. Imported information may be incomplete, outdated, or subject to the source provider’s policies.
YaySite does not guarantee the availability, accuracy, ownership, or continued access to third-party profiles, photos, reviews, maps, domains, email services, payment services, or authentication providers. Your use of third-party services is also subject to their terms.
6. Lead Capture and AI Chatbot
If you enable Lead Capture, you are responsible for the form fields, notification email, response process, privacy notice, consent language, retention practices, and lawful handling of visitor submissions. Do not request sensitive personal information unless you have a lawful basis and appropriate safeguards.
AI Chatbot output may be incomplete, inaccurate, or unsuitable for a particular visitor. You are responsible for reviewing its business context, configuring it appropriately, and ensuring published answers do not create misleading, professional, medical, legal, financial, or safety claims.
7. Domains, publishing, and public websites
You are responsible for owning or being authorized to use any domain you connect. You authorize YaySite to provide the DNS or hosting configuration needed for the requested connection, but you remain responsible for registrar access, renewals, DNS changes, email records, and conflicts with existing services.
Once published, a website may be publicly accessible and indexed or shared by others. You are responsible for the content and operation of each website you publish, including required privacy policies, terms, cookie notices, accessibility information, business disclosures, and contact details.
8. Acceptable use
You may not use YaySite to break the law, infringe rights, impersonate a person or business, publish deceptive or malicious content, distribute malware, abuse forms or email, scrape or overload the service, bypass plan or security controls, upload unlawful personal data, or interfere with another user’s website or account.
We may remove content, disable features, suspend an account, or take other reasonable action when we believe these terms, law, third-party rights, or platform safety are at risk.
9. Plans, payment, and refunds
Any pricing, usage limits, trial terms, renewal terms, taxes, and refund rules shown at checkout or on the applicable plan page form part of your purchase. You authorize the payment provider to charge the selected payment method for recurring plans until cancellation.
You can cancel future renewals through the available account or billing controls. Cancellation normally takes effect at the end of the current paid period unless the checkout terms state otherwise. We may change pricing prospectively with reasonable notice.
10. Intellectual property
YaySite’s software, interface, branding, templates, documentation, and underlying technology are owned by YaySite or its licensors and protected by applicable intellectual-property laws. These terms give you a limited right to use the service; they do not transfer YaySite’s intellectual property to you.
You may provide feedback, ideas, or suggestions. You grant us permission to use that feedback without restriction or payment, provided we do not identify you publicly without permission.
11. Availability and disclaimers
YAYSITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT PROMISE THAT THE SERVICE, IMPORTED DATA, GENERATED CONTENT, AI OUTPUT, DOMAINS, EMAIL DELIVERY, OR PUBLISHED WEBSITES WILL ALWAYS BE ACCURATE, COMPLETE, AVAILABLE, SECURE, OR ERROR-FREE.
YOU ARE RESPONSIBLE FOR BACKUPS, REVIEW, LEGAL COMPLIANCE, AND THE BUSINESS OUTCOME OF WEBSITES YOU CREATE. NOTHING IN YAYSITE IS LEGAL, MEDICAL, FINANCIAL, OR PROFESSIONAL ADVICE.
12. Liability and indemnity
To the maximum extent permitted by law, YaySite and its providers will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages, or for loss of data, revenue, reputation, domain access, or business opportunity arising from your use of the service.
To the maximum extent permitted by law, our total liability for claims relating to the service will not exceed the greater of the amount you paid us for the service during the three months before the event giving rise to the claim or 100 US dollars.
You agree to defend and indemnify YaySite and its providers from claims, losses, liabilities, and expenses arising from your content, your websites, your use of imported or third-party data, your violation of these terms, or your violation of another person’s rights.
13. Suspension, termination, and changes
You may stop using YaySite at any time. We may suspend or terminate access if you breach these terms, create risk, fail to pay, or if we discontinue the service. On termination, your right to use the service ends; provisions that should reasonably survive—such as ownership, disclaimers, liability, indemnity, and dispute terms—will survive.
We may update these terms as the service changes. We will update the date above and, when appropriate, provide notice. Continued use after an update means you accept the revised terms.
14. General terms and contact
These terms and any dispute relating to them will be interpreted under the laws applicable to the YaySite operator’s principal place of business, without regard to conflict-of-law rules, except where mandatory consumer law provides otherwise. If any provision is unenforceable, the remaining provisions remain effective.
Questions about these terms can be sent to support@yaysite.com.
